What is Mediation?
Mediation is an alternative dispute resolution method where a neutral and impartial person, called a mediator, helps conflicting parties find a mutually acceptable solution and reach a peace agreement without resorting to court.
Key Aspects and Advantages of Mediation:
Facilitation: Being neutral, the mediator does not advise the parties or make decisions for them. Their goal is to help the parties restore communication, express their positions, and hear and understand the other person's needs and interests in a safe environment.
Voluntariness: Typically, the mediation process is voluntary; both parties agree to participate and can withdraw at any time. However, in certain cases, such as in family disputes in Lithuania, mediation may be mandatory.
Confidentiality: Everything discussed during mediation is confidential and cannot be used in court proceedings if an agreement isn't reached. This allows parties to feel safe and openly discuss their problems.
Flexibility and Speed: Mediation is a flexible process that can be adapted to the parties' needs, schedules, and circumstances. It is generally a faster and less expensive way to resolve disputes than litigation.
Effectiveness and Sustainability: Decisions are made by the disputing parties themselves, so they are often better tailored to their needs and are more sustainable than court decisions. This helps preserve or even improve mutual relationships in the future.
Costs: Depending on the situation, mediation services may be paid for or covered by the state budget (e.g., for a certain number of hours in mandatory mediation cases).
Where is Mediation Applied?
Mediation can be applied in various disputes, such as:
Family disputes: Divorce, child maintenance, visitation arrangements. In Lithuania, mandatory mediation is applied to family disputes.
Employment disputes: Conflicts between employees and employers.
Commercial (business) disputes: Breach of contracts, partnership issues.
Other civil disputes: Property, neighbor disputes, etc.
Criminal procedure law: To resolve conflicts between the victim and the accused, compensating for damages caused.
If mediation fails and an agreement is not reached, the parties do not lose the option to go to court. However, successful mediation allows avoiding a long, expensive, and emotionally difficult litigation process.
